What is Form 940?
Form 940, Employer's Annual Federal Unemployment (FUTA) Tax Return, is how employers report the federal unemployment tax they owe for the year. FUTA helps fund unemployment benefits for workers who lose their jobs.
FUTA tax is paid by the employer only. You don't withhold it from your employees' wages.
Who needs to file Form 940?
Most employers who pay wages above a certain amount in a calendar quarter, or who have employees for part of a day in a set number of weeks during the year, must file Form 940. Household employers and agricultural employers have their own tests.
Tax-exempt 501(c)(3) organizations generally don't file Form 940. Check the current IRS instructions to confirm whether the thresholds apply to your business.
When is Form 940 due?
Form 940 is filed once a year, and it's generally due by January 31 for the previous calendar year. If you deposited all of your FUTA tax on time, you usually get until February 10.
Keep in mind that FUTA tax deposits may be due quarterly during the year, even though the return itself is annual.
How do I fill out Form 940?
Start with your EIN, business name, and address at the top. In Part 1, tell the IRS which state you paid state unemployment tax in, or check the box for multiple states and attach Schedule A. Parts 2 through 4 figure your FUTA tax before and after adjustments, such as credit reductions for certain states.
If your FUTA tax is more than $500 for the year, report your liability by quarter in Part 5. Finish with Part 6 if you want to name a third-party designee, then sign and date the form in Part 7.
What's a common mistake on Form 940?
A frequent issue is forgetting Schedule A when you paid wages in more than one state or in a credit reduction state. Another is leaving out payments that are exempt from FUTA, which can make your taxable wage total too high.
Double-check your state unemployment contributions too, since they affect the credit you can take against FUTA tax.
